Despite its potential implications for the objectivity of scientific knowledge, the claim that “scientific instruments are perspectival” has received little critical attention. I show that this claim is best understood as highlighting the dependence of instruments on different perspectives. When closely analyzed, instead of constituting a novel epistemic challenge, this dependence can be exploited to mount novel strategies for resolving two old epistemic problems: conceptual relativism and theory-ladeness. The novel content of this article consists in articulating and developing these strategies (...) by introducing two fine-grained notions of perspectives as the key units of analysis: “broad perspectives” and “narrow perspectives.”. El presente artículo se centra en el papel que ésta desempeña en el desarrollo de la vida espiritual y trascendental. Para ello, realizaremos un repaso histórico de su evolución estética y social, abordaremos dicho fenómeno a nivel fisiológico y presentaremos sus aplicaciones clínicas y sociales. Seguidamente y a modo de ejemplo de las concepciones de pensamiento occidental y oriental, trataremos la forma en que el cristianismo y (...) el budismo conciben la música dentro de su doctrina. We introduce the papers in this special issue by providing an overarching perspective on the variety in kinds of commons and the ethical issues stemming from their diversity. Despite a long history of local commons management, recent decades have witnessed a surge of scholarly interest in the concept of “the commons,” including a growing management literature. This swell was impelled especially by Garrett Hardin’s paper of 1968, and the body of work generated by Elinor Ostrom and her colleagues. However, the (...) term itself has come to be used in a variety of ways. To contextualize its ethical dimensions, we map a number of commons-related concepts such as common-pool resources, common property regime, excludability and subtractability, common-pool resource types and commons or “commoning” as a source of production. Following a brief summary of papers in this special issue, the essay concludes with an identification of implications for research, practice and policy. (shrink)

Spin is a fundamental and distinctive property of the electron, having far-reaching implications. Yet its purely formal treatment often blurs the physical content and meaning of the spin operator and associated observables. In this work we propose to advance in disclosing the meaning behind the formalism, by first recalling some basic facts about the one-particle spin operator. Consistently informed by and in line with the quantum formalism, we then proceed to analyse in detail the spin projection operator correlation function \=\left\langle (...) \left \left \right\rangle \) for the bipartite singlet state, and show it to be amenable to an unequivocal probabilistic reading. In particular, the calculation of \\) entails a partitioning of the probability space, which is dependent on the directions \.\) The derivation of the CHSH- or other Bell-type inequalities, on the other hand, does not consider such partitioning. This observation puts into question the applicability of Bell-type inequalities to the bipartite singlet spin state. (shrink)

This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in. The International Criminal Court (ICC) is responsible for prosecuting individuals for heinous crimes that take place during civil and/or international armed conflicts, including sexual violence. Prosecuting this crime relies primarily on survivor accounts, but witnesses often fear the psychological effects of giving such testimony, particularly because there is a high risk of retraumatization, a stigma associated with victimhood, and a fear of victim-blaming. Thus, the Court’s Victims and Witness Unit (VWU) puts forth provisions for questioning vulnerable witnesses, requiring, in part, (...) that questioners avoid embarrassing or offending witnesses. Using a discourse analytic approach, this paper examines transcripts from three recent ICC cases dealing with wartime sexual violence—_Bemba, Ongwen_, and _Katanga and Chui—_exploring the discursive strategies employed by prosecutors and defense attorneys in these trials as they navigate arguing their cases before the judges while also tailoring their questions to adhere to the VWU’s provisions. I show that adhering to the provisions often involves relying on euphemistic expressions to discuss rape—which enter the trial discourse through linguistic formulations and reformulations—even though these expressions reflect the language used to discuss consensual sex and not sexual violence. Thus, this method of adhering to the provisions can undermine the prosecution’s case while helping the defense’s. (shrink)

Like other postmodern structures, post-industrial labour markets display more frequent and rapid changes and higher unpredictability. In these conditions, the world of work is less capable in providing individuals stable signals for the construction of their behaviours. This paper aims to examine both macro and micro factors that shape labour market participation and expectations related to employment outcomes. We explore statistical data from the World Values Survey Wave 7 collected from almost seventy thousands individuals around the world. Education can be seen as an investment that brings higher incomes to individuals. People with higher levels of education collect important earnings premium in the labour market. On the other hand, the expansion of education is a major trend that characterizes evolution of societies, with important positive effects at the level of social and economic development. This paper aims to explore the influence of educational attainment on subjective incomes of individuals, while taking into account other relevant personal factors, as well (...) as the phenomenon of education expansion at national level. We build our analysis on data from the World Values Survey Wave 7 collected from individuals around the world in various national settings. Our results are useful for better understand the influences of increasing participation to education on the earnings structure at both individual and national levels. (shrink)

This article refers to selected issues elaborated from my interdisciplinary doctoral thesis accomplished at the University of South Africa in 2019. I investigated the ethical-theoretical frameworks as well as practices of Christian humanitarian non-governmental organisations in Germany by combining a theoretical part and an empirical part. The empirical part was accomplished by interviewing 11 NGOs from the humanitarian field. The findings of theory and practice showed that many Christian NGOs typically conform to the secular mindset and regulations in order to (...) be able to function as organisations. The results also revealed that Christian NGOs have difficulties in defining their identity in order to be attractive and convincing to their current and prospective employees and donors. In addition, organisational and hierarchical structures are mostly taken from business companies but do not necessarily always fit to the individual organisations. The research is significant because it shows to what extent these NGOs experience tensions and insecurities having to work in a secular environment, and it helps to identify some typical challenges that Christian organisations face in Western countries. The purpose of the thesis was to impact on the reflection and practice of leaders of NGOs in their quest to understand developments and paradigm shifts, and ensure that they will act in a recognisably Christian way.Contribution: This article has been held as a presentation at the Leadership Conference in Pretoria, South Africa, in 2019. It contributes to the research of specific Christian leadership, and particularly of leadership in Christian non-governmental organisations. Art opens itself to many different functions. In principle, one cannot exclude that a work of art acts as stimulant or relaxant, that it provides cognitive benefits or serves social aims. However, the fact that it fulfills a certain function does not transform a product into an artistic creation, nor does it prevents it from being art. Rather the capacity to open an unlimited functional and meaningful space is what comprises the autonomy and the artistic quality of a work.

El presente artículo parte del presupuesto de que el trabajo de la memoria tiene un efecto transformador y liberador, si es llevado a cabo de forma dinámica, creativa y participativa. Como se verá, las experiencias y producciones estéticas adquieren aquí una función destacada, especialmente cuando se comparten de manera abierta y solidaria en una comunidad. Se argumentará que el fomento del trabajo productivo de la memoria con medios estéticos es una labor que no puede ni debe terminar nunca, puesto que (...) tiene una importancia vital para los procesos emancipadores del ser humano. Cuando se activa el potencial productivo y transformador de la memoria, se trascienden historias cerradas, unívocas y homogéneas, como las que propaga una memoria meramente reproductiva, puesta al servicio de una ideología imperante. Esta tesis central será analizada en sus implicaciones filosóficas y discutida contraponiendo la «memoria comunitaria», esencialmente productiva y transformadora, a la «memoria oficial» que procede de manera reproductiva y manipulativa. Ejemplos de iniciativas comunitarias del contexto colombiano ilustrarán finalmente de qué manera medios estéticos pueden despertar y fomentar una memoria crítica y transformadora, capaz de convertir historias cerradas, ignoradas o reprimidas en posibilidades que se abren a la vida. Resumen: Espacio y tiempo son conceptos inseparables. La relación que los une es tan estrecha que el espacio puede considerarse la otra cara del tiempo, y viceversa. La unidad y a la vez alteridad espacio-temporal representa un problema fundamental tanto para la ciencia, especialmente la física, como para la filosofía y el arte. Aunque puede haber puntos de encuentro entre las concepciones de las diferentes áreas, se observan diferencias fundamentales en la manera de entender ambos conceptos y la relación entre (...) ellos. El espacio y tiempo de la física clásica y el espacio lógico de Wittgenstein, ligado al presupuesto de la simultaneidad, son presuposiciones teóricas necesarias para establecer leyes físicas o bien para lograr representaciones exactas. Frente a la noción científica y transcendental está la concepción ontológica de Heidegger y la artística de Chillida. Renunciando al ideal de la exactitud, de lo medible y comprobable, el filósofo y el escultor entienden la mutua pertenencia de espacio y tiempo como algo que tiene una importancia fundamental para la vida humana y que representa un reto que hay que buscar.: Space and time are inseparable concepts. The relationship that joins them is so close that one can understand space as the opposite side of time, and vice versa. Unity and otherness of space and time constitute a fundamental problem for science, especially physics, as well as for philosophy and art. Although there may be connecting lines between the conceptions those different fields hold on space and time, one observes fundamental differences in the way they understand these two concepts and the relation between them. The conception of space and time in classical physics, as well as in Wittgenstein’s notion of logical space connected with the principle of simultaneity, represent necessary theoretical premises in order to establish physical laws and precise representations. Opposite to the scientific and transcendental concepts, we find Heidegger’s ontological and Chillida’s artistic conceptions. Giving up the ideal of precision, of measurement and verification, the philosopher and the sculptor understand the mutual belonging of space and time as something that has a fundamental importance in human life, and that constitutes a challenge that one can only search for. Introduction: The teacher-student relationship in medicine determines the bond established with the patient. Objective: This study was designed to compare if first and third year medical students at a university perceived incidents perpetrated by teachers as morally wrong. Materials and methods: A semi-structured survey was used with open and closed items; specifically, participants were asked to relate a morally wrong incident, classified to six categories. Results: 80.7% in the third-year students and 30.4% of the first-year students perceived incidents that involved (...) mostly auxiliary personnel and evaluations. Verbal abuse and unfair assessment were the categories mentioned the most. Discussion: A morally wrong incident is a general concept, differing from other studies that specifically analyze abuse, also evident in this concept. Conclusion: A lack of respect and justice could indicate a lack of moral commitment. (shrink)

La reanimación cardiopulmonar (RCP) por testigos aumenta la supervivencia pero no hay formación en RCP en España en el sistema educativo.Este trabajo analiza la implementación de un programa de formación para profesores de Educación Secundaria por parte de sanitarios y, posteriormente, la adquisición de competencias por parte del alumnado comparando según el docente que los ha formado (profesor/a o sanitario), en un instituto de Granada (...) (España), objetivando una adquisición de competencias adecuada a todos los niveles y mejor cuando el docente es profesor/a. (shrink)

En este trabajo abordo un caso específico del problema clásico de la individuación en la Filosofía de la Biología: el de las colonias de insectos, y en particular, de hormigas. El carácter individual de un conjunto de hormigas que forman una colonia puede ser objeto de controversia, ya que, desde un punto de vista intuitivo, no parece constituir un individuo. Mi objetivo es demostrar que las colonias de hormigas son individuos biológicos. Para ello, me centro en dos de los tipos (...) de individuos más estudiados en la Filosofía de la Biología: los funcionales y los evolutivos, y examino si las colonias de hormigas cumplen con las condiciones necesarias para ser consideradas individuos en estos términos. En el libro Teorías sin disciplina, los teóricos Santiago Castro-Gómez, Alberto Moreiras y Walter Mignolo, cuestionan los discursos producidos sobre América Latina desde la academia estadounidense y latinoamericana, notablemente influida por la visión del país del norte. Postulan la necesidad de producir nuevos discursos vinculados con lo local y lo diverso en respuesta al impulso homogeneizador globalizante vigente en la actualidad. Aquí, presentamos un recuento de las reflexiones de estos teóricos y las ponemos en diálogo con la obra literaria del (...) Elicura Chihuailaf titulada Recado confidencial a los chilenos. El objetivo de este artículo es evidenciar el carácter poscolonial y posoccidental de una obra literaria que es en sí misma un forma de resistencia y de oposición a esa homogenización discursiva de la identidad latinoamericana que, desde la occidentalización y la permanencia del pensamiento colonial, ha imperado por largo tiempo en los estudios latinoamericanistas. We can say that Picasso’s images speak to us, and, as writing, speak to us from that space in which any text – far from being reduced to a single sense – “disseminates” its “truths”. Using the figure and the story of the Minotaur, Picasso devoted himself to one of the great themes of his pictorial work. The word “labyrinth” connotes, to the European mind, Greece, Knossos, Dedalus, Ariadne and the Minotaur. However, the Greek formula already represents a mythic and (...) poetic outcome thoroughly developed from an imagery forged in the remotest eras of our evolution. The relationship between the image, the spiral, and the word, labyrinth is also linked to the perception of a drilled earth, excavated, with numberless tortuous tunnels which, in our imagination, provoke concern because they lead to the world of the inferi, the unknown depths of the realms of the dead. Juan Larrea, a little-known essayist in the sphere of philosophical studies, although, from the outset of international renown for Picasso’s work, he gives what is perhaps the best interpretation of Guernica and consequently also sheds much light on the engravings immediately preceding the execution of this painting, the Minotauromachy among them. The artist is not a prophet. He is not foreseeing what the future holds for humanity, but he does possess a heightened sensitivity that drives him to minutely scrutinise the conditions of the time that he has had to live, and he has a transforming eye for the symbols that constitute the deepest threads in the fabric of his culture. Cette étude vise à comprendre les spécificités sémantiques des lexèmes manipuler et modifier afin d’éclairer l’usage qui en est fait en bioéthique lorsque les actions désignées ont comme objet l’embryon, le cerveau, l’ADN, l’Homme, le vivant ou la procréation. En s’appuyant sur les définitions des dictionnaires et sur les réponses à un questionnaire soumis aux locuteurs, et en se servant de concepts de la sémantique combinatoire, de la sémantique argumentative, de la sémantique des cadres et de l’aspect sémantique, l’étude identifie (...) les éléments de signification propres à chacun des deux lexèmes. Ces éléments sont étroitement liés au potentiel de signification des lexèmes et aux traits aspectuels des procès qu’ils désignent. À l’issue de cette étude, un ensemble de traits sémantiques caractéristiques de chaque lexème est proposé, dans une perspective contrastive. (shrink)

This paper raises the possibility of a female authorship for the anonymous 14th century work The Cloud of Unknowing, which academics always attribute to a man. It points out four premises: firstly the error of sexual attribution of the authorship of The Mirror of Simple Souls, maintained until 20th century; secondly, the conception of woman by the English mystical male writers Rolle and Hilton, which is not found in the writings attributed to the author of The Cloud; thirdly, the literary, (...) theological and mystical greatness of a English woman writer of 14th century, Julian of Norwich; and, finally, the scholars' considerations about the author (man for them) of The Cloud and its related treatises, which, notwithstanding, could perfectly be attributed to a woman of the fourteenth century in England. So, the conclusion invites to question the male authorship of this masterpiece, perhaps, for the first time. (shrink)

Classifications are useful and efficient. We group things into kinds to facilitate the acquisition and transmission of important, often tacit, information about a particular entity qua member of some kind. Whilst it is universally acknowledged that classifications are useful, some scientific classifications (e.g. chemical elements) are held to higher epistemic standards than folk classifications (e.g. bugs). Scientific classifications in terms of ‘natural kinds’ are considered to be more reliable and successful because they are highly projectible and support law-like and inductive (...) generalisations. What counts as a natural kind is, however, controversial: according to essentialists (e.g. Putnam, Kripke, Ellis) natural kinds are mind-independent and possess essential characteristics; according to promiscuous realists (e.g. Dupre ) there are ‘countless legitimate, objectively grounded ways of classifying objects in the world’; and according to scientific realists (e.g. Boyd, Psillos) natural kinds are grounded in the ‘causal structure of the world’. More specifically, realism about kinds can be understood as a commitment to the existence of natural divisions (kinds) in the world that we come to know as a result of mature scientific investigation into the nature of such kinds. Realism about natural kinds is supported and articulated in terms of three main arguments, metaphysical, semantical, and epistemological. In the first part of my thesis I offer a sustained and systematic investigation of these three main arguments, with their respective promises and prospects for the viability of realism about kinds and I find them wanting, whilst in the second part of the thesis I pursue an unexplored line of inquiry regarding natural kinds and propose a mild realism about natural kinds via the ontology of real patterns. El trabajo presenta los resultados del proyecto El paisaje sonoro como contexto de aprendizaje interactivo, transversal e interdisciplinar (PAISO) que se desarrolló durante los cursos 2019-2020 y 2020-2021 en la Facultad de Magisterio de la Universidad de Valencia. La muestra participante estuvo formada por 748 estudiantes de 16 asignaturas de los grados en Maestro/a en Educación Primaria e Infantil y los Másteres de Secundaria y Máster en Investigación en Didácticas Específicas de la Universidad de Valencia y de la Universidad de (...)
